We even expected a unanimous verdict – NPP’s Koduah reacts to Supreme Court Kpandai ruling

The General Secretary of the New Patriotic Party (NPP), Justin Frimpong Koduah, has welcomed the Supreme Court’s decision to quash a Tamale High Court ruling that annulled the election of Matthew Nyindam as Member of Parliament for Kpandai, describing it as a clear upholding of the law.

In a reaction to journalists at the Supreme Court premises following the 4-1 majority verdict delivered on Wednesday, January 28, 2026, Mr. Koduah expressed confidence that the NPP entered the legal battle knowing the law favoured their position.

“It is the law that has worked. For us the NPP, we knew the law was on our side going to court. Because the law says you have 21 days to challenge a result after an election is held. The NDC failed to meet the 21 days deadline. They went to court after 32 days and that is what we raised issues that it is not what the law says,” he stated.

He explained that the party was convinced the judges would not overlook the statutory timeline under Ghana’s electoral laws, which require election petitions to be filed within 21 days of the gazette notification of results by the Electoral Commission.

“So we were very much convinced that there was no way the judges will overrun the issue of the law is upheld. In fact, we were even expecting a unanimous decision. We are shocked the presiding judge dissented. So we’re also waiting to see his reasoning for dissenting because we know this was a very straightforward matter,” Mr. Koduah added.

The Supreme Court, in its ruling, restored Nyindam’s parliamentary seat, citing jurisdictional error in the High Court’s decision to entertain the NDC’s petition filed outside the mandatory period.

Justin Koduah emphasised that the outcome benefits not only the NPP but the nation as a whole by safeguarding democratic principles.

“We are happy that the law has been upheld and it’s not the benefit of the NPP alone, it’s to the benefit of the country. At least, we are protecting and safeguarding our democracy and that should be the attitude and the behavior of the bench. So we are grateful to the court for the laws of this country,” he concluded.
