NDC is aggrieved – Dafeamekpor reacts to Supreme Court ruling on Kpandai

The National Democratic Congress (NDC) has expressed deep disappointment over the Supreme Court’s decision to quash a High Court ruling that had annulled the election of Matthew Nyindam as Member of Parliament for Kpandai, restoring the New Patriotic Party (NPP) candidate to the seat.

In a 4-1 majority ruling, the apex court held that the High Court erred in law when it annulled Nyindam’s victory in the December 2024 parliamentary election, with Justice Gabriel Scott Pwamang delivering the sole dissenting opinion.

Reacting to the judgment shortly after it was delivered at the Supreme Court premises on Wednesday, January 28, 2026, NDC Member of Parliament for South Dayi, Nelson Rockson Dafeamekpor, described the party as “aggrieved” by the outcome and indicated that guidance would be offered to the party’s candidate on the way forward.

“As a party, we are aggrieved by this decision, and therefore, we will advise our candidate on the matter regarding the next step to take,” he told reporters.

Dafeamekpor who is also the Majority Chief Whip, argued that the court, being one of both law and equity, ought to have given due weight to the official gazette notification published by the assembly press under the authority of the Electoral Commission, which formed the basis for the swearing-in of Members of Parliament, including himself.

“That cannot be a gazette that will be discounted by the court because it is a public document. The NPP cannot benefit from that gazette notification and come to court to say that that is not a proper document,” he contended.

The Supreme Court’s decision came after Matthew Nyindam invoked the court’s supervisory jurisdiction, challenging the High Court’s ruling on grounds of jurisdictional error.

With the annulment now overturned, Matthew Nyindam’s position as the duly elected MP for Kpandai in the Northern Region has been reinstated.
