Kpandai Seat: Parliament sends notice of vacancy to EC over High Court order

The Parliamentary Service has officially notified the Electoral Commission (EC) of a vacancy in the Kpandai Constituency seat following a Tamale High Court order for a complete re-run of the 2024 parliamentary election in the area.

In a letter dated December 4, 2025, and signed by Clerk to Parliament, Mr Ebenezer Ahumah Djietror, the EC Chairperson, Mrs Jean Mensa, was informed of the vacancy “occasioned by the Order of the High Court, Tamale, for a re-run of the Kpandai Parliamentary Elections” delivered on November 24, 2025.

The notification, issued under Article 112(5) of the 1992 Constitution, triggers the legal process for the EC to organise a fresh election to fill the seat.

Article 112(5) mandates that whenever a vacancy arises in Parliament, the Clerk must notify the EC, which is then required to conduct a by-election within 90 days, unless the vacancy occurs less than three months before Parliament is dissolved.

With the notification now served, the Electoral Commission has until early March 2026 to hold the re-run in the Northern Region constituency.

The High Court’s November 24 ruling invalidated the original 2024 parliamentary results in Kpandai after finding irregularities serious enough to warrant a fresh poll.

The upcoming re-run is expected to attract intense campaigning from both the ruling National Democratic Congress (NDC) and the opposition New Patriotic Party (NPP), as the outcome could affect the delicate balance of power in the current Parliament.

The Electoral Commission is expected to release the election timetable, including nomination periods and the polling date, in the coming weeks.

The court ruled that the declaration of the  New Patriotic Party candidate, Matthew Nyindam as the winner of the election was not valid.
