Petition for removal of Yonny Kulendi as Supreme Court judge fails

A petition seeking the removal of Supreme Court Justice Yonny Kulendi has failed after the Chief Justice determined that it did not establish a prima facie case.

Felix Kwakye Ofosu, Spokesperson for President John Dramani Mahama, announced the development in a post on Wednesday, December 16, 2025.

According to the post, the President forwarded the petition to the Chief Justice in line with Article 146 of the 1992 Constitution to assess whether a prima facie case existed.

The Chief Justice subsequently informed the President that the petition did not disclose any prima facie case.

The President has since communicated the Chief Justice’s decision to the petitioner, effectively closing the matter without further action.

“In the matter of a petition brought against Justice Yonny Kulendi, the following facts suffice.

“1) The President forwarded the petition to the Chief Justice to determine wether or not there was a prima facie case in accordance with Article 146 of the Constitution.

“2) The Chief Justice wrote to the President indicating that the petition did not disclose a prima facie case.

“3) The President has. communicated what Chief Justice said to the petitioner,” Kwakye Ofosu who also doubles as the Minister for Government Communications wrote.

The petition, filed in October 2025 by private citizen Daniel Marfo Ofori-Atta, alleged stated misbehaviour by Justice Kulendi.

It claimed the judge improperly interfered in the high-profile ambulance procurement trial involving Now-Minister for Finance, Dr. Cassiel Ato Forson and businessman Richard Jakpa, who is said to be Kulendi’s cousin.

Ofori-Atta accused Justice Kulendi of facilitating meetings between Jakpa and then-Attorney General Godfred Yeboah Dame in an attempt to influence the case outcome.

Under Article 146 of the Constitution, petitions for the removal of Superior Court Justices (other than the Chief Justice) require the Chief Justice to first determine if a prima facie case exists before any committee is formed for investigation.

Since no prima facie case was found, no further proceedings will take place.

Justice Emmanuel Yonny Kulendi was appointed to the Supreme Court bench in May 2020 by former President Nana Addo Dankwa Akufo-Addo.
