Fintech firm Zeepay Ghana Ltd and its Managing Director, Andrew Takyi-Appiah, have sued Scancom PLC, operator of MTN Ghana, and Mobile Money Fintech Ltd, which runs MTN Mobile Money (MoMo). They allege that a Zeepay corporate wallet was wrongly registered in Mr Takyi-Appiah’s personal name.

The writ of summons was filed at the High Court, Accra (General Jurisdiction) on 23 October 2026. It seeks GH¢10 million in general damages and GH¢5 million in exemplary damages for Mr Takyi-Appiah, plus unspecified damages for Zeepay for breach of contract.

According to the statement of claim, Zeepay is a Mobile Financial Service Provider and Payment System Service Provider. Around 2022 or 2023 it subscribed to an MTN MoMo corporate wallet, known as an OVA wallet, for its business.

Zeepay says it later discovered the wallet’s ownership had been registered in Mr Takyi-Appiah’s name. It claims all the subscription and know-your-customer (KYC) documents were in the company’s name.

On 21 November 2023, Zeepay says, it wrote to the defendants instructing them to transfer ownership to the company and supplied supporting documents. Reminders followed up to August 2026. The plaintiffs say the wallet still bore Mr Takyi-Appiah’s name when the suit was filed.

The filing also says the defendants justified the registration by treating Mr Takyi-Appiah as the wallet’s handler. The plaintiffs reject that, arguing that the holder of an OVA wallet is not necessarily its owner.

Mr Takyi-Appiah claims the registration has caused him pain, distress and reputational harm because he has been joined personally to lawsuits against Zeepay. He says the High Court in Accra has refused to remove him as a party in those pending cases because his name appears as the wallet’s owner on MTN’s platform.

He argues that he has a legal personality separate from the company. The filing describes the defendants’ conduct as reckless, oppressive and in complete disregard of both plaintiffs’ rights.

The plaintiffs are claiming against both defendants jointly and severally. They want the court to declare that registering Zeepay’s wallet in Mr Takyi-Appiah’s name was wrongful and unlawful. They also want declarations that the defendants breached their duty to Zeepay by failing to act on its instructions, and that they are liable for any harm Mr Takyi-Appiah has suffered or will suffer.

The plaintiffs are seeking an order directing the defendants to remove his name and comply with Zeepay’s November 2023 instructions.

On damages, Zeepay seeks general damages for breach of contract. Mr Takyi-Appiah seeks GH¢10 million in general damages and GH¢5 million in exemplary damages. Both are also claiming costs, including legal fees.
