The Kumasi High Court will on Friday, November 28, 2025, deliver judgement in the high-profile case involving the right to perform widowhood rites for the late highlife legend Charles Kwadwo Fosu, popularly known as Daddy Lumba.
The suit, filed by Akosua Serwaa Fosuh, seeks a declaration that she is the only surviving wife of the late musician and should exclusively perform all customary widowhood rites at his funeral. She is also praying the court for an order restraining one Odo Broni, whom she accuses of falsely holding herself out as Daddy Lumba’s wife.
Joined as defendants are Abusuapanin Kofi Owusu, head of the Ekuona family of Parkoso in Kumasi, and Transitions Funeral Home in Accra.
Four witnesses have so far testified in the case: the legal attorney for Akosua Serwaa Fosuh; Ernestina Fosuh, sister of the late musician; Osei Sarfo Kantanka, an expert in Akan customary law from the Manhyia Palace; and Abusuapanin Kofi Owusu of the Ekuona family.
According to a report by Myjoyonline, at least two more defence witnesses are expected to testify as the hearing continues today, Monday, November 24, 2025.
Presiding judge, Her Ladyship Justice Dorinda Smith-Arthur, initially scheduled judgement for Tuesday, November 25, but has now fixed Friday, November 28, 2025, as the new date.
She has directed both parties to file their written addresses by close of Wednesday, November 26, effectively requiring all oral arguments to conclude by Tuesday.
If the timeline is adhered to, the court would have disposed of the emotionally charged case in under two weeks – a rarity in Ghana’s judicial system.
Proceedings resume this morning with counsel for Akosua Serwaa Fosuh expected to continue the cross-examination of Abusuapanin Kofi Owusu.
