Supreme Court cancels High Court order for Kpandai election re-run

The Supreme Court has overturned a Tamale High Court ruling that annulled the 2024 parliamentary election results in the Kpandai constituency, restoring Matthew Nyindam of the New Patriotic Party (NPP) as the duly elected Member of Parliament for the area.

In a 4-1 majority decision delivered on Wednesday, January 28, 2026, the apex court quashed the High Court judgment, with Justice Pwamang delivering the sole dissenting opinion.

The ruling ends months of legal uncertainty surrounding the Kpandai seat, which has been the subject of a prolonged electoral dispute since the December 7, 2024 general elections.

The controversy began when the Tamale High Court, presided over byJustice Emmanuel Bart Plange Brew, annulled Nyindam’s election following a petition filed by the National Democratic Congress (NDC) parliamentary candidate, Daniel Nsala Wakpal.

The petitioner had alleged serious irregularities in the electoral process that materially affected the outcome of the polls.

Dissatisfied with the High Court’s decision, Nyindam appealed to the Supreme Court, which has now set aside the annulment and restored his parliamentary mandate.

The decision strengthens the NPP’s position in Parliament, where the ruling National Democratic Congress holds a large majority.
