Court of Appeal orders A-G to make key disclosures in Adu-Boahene trial

The Court of Appeal has ordered the Attorney-General to release specific documents and financial records to former National Signals Bureau Director-General Kwabena Adu-Boahene and his wife, Angela Adjei-Boateng, in their ongoing GH¢49.1 million criminal trial.

The order, dated 28 May 2026 and transmitted to the High Court Registrar on 10 June 2026, partially grants a disclosure request by the accused following an interlocutory appeal against an earlier High Court ruling.

The court directed the Republic to produce the missing pages 2 to 89 of Advantage Solutions Company Limited’s bank statement at Universal Merchant Bank (UMB). It also ordered disclosure of the source of the GH¢49.1 million paid into the National Security Coordinator’s Special Operations Account and later transferred to B.N.C Communications Bureau Limited’s UMB account.

Other items to be disclosed include the file compiled by former National Security Coordinator Joshua Kyeremeh on the cyber defence system acquisition, relevant correspondence on Angela Adjei-Boateng’s vetting and use as a confidential source, National Security Coordinators’ special operations accounts linked to Adu-Boahene, and clarification on whether the funds were solely for importing the cyber defence system.

Adu-Boahene and his wife, together with Mildred Donkor and Advantage Solutions Limited, face 11 counts, including stealing, money laundering, defrauding by false pretences and causing financial loss to the state. All have pleaded not guilty and are on bail.

The accused were arrested by EOCO in March 2025 over the purchase of cyber intelligence equipment during Adu-Boahene’s tenure as NSB Director-General. Prosecutors allege diversion of funds from a US$7 million contract signed in January 2020.

In November 2025, the Court of Appeal dismissed a defense request for national security documents dating back to 1992. The trial at the High Court continues, as disclosure remains a continuing obligation.
