Constitutional abomination – NPP rejects Kpandai election rerun

The New Patriotic Party (NPP) has vehemently condemned the High Court ruling that annulled the 2024 parliamentary election in the Kpandai constituency and ordered a fresh poll, labelling the decision a “constitutional abomination” that threatens Ghana’s democracy.

National Organiser of the NPP, Henry Nana Boakye (Nana B), told journalists in Accra on Tuesday, December 9, 2025, that the judgment delivered by Justice Emmanuel Brew Plange was “deeply flawed,” “reckless,” and “legally unsound.”

The court nullified the election  won by the NPP candidate with a 3,734-vote margin, after a petition challenged irregularities affecting only about 500 votes.

Mr Boakye argued that the ruling blatantly ignored established legal principles, which require that electoral irregularities must be substantial enough to affect the overall outcome before an entire election can be cancelled.

He said the decision “defies basic logic” and sets a dangerous precedent that could destabilise Ghana’s electoral system if allowed to stand.

The NPP Organiser further accused the judge of disregarding Regulation 48 of CI 127, which clearly states that the absence of a candidate or their agent does not invalidate actions taken by a Returning Officer.

“This judgment undermines justice and weakens the democratic institutions we have all worked hard to build,” he stated.

While reaffirming the party’s respect for the judiciary, Nana B stressed that the NPP will not sit idly by in the face of what he described as a “major injustice.”

“Democracy must be protected at all costs,” he declared, assuring Ghanaians that the party is exploring all lawful avenues to overturn the ruling.

The High Court had ordered the Electoral Commission to conduct a fresh parliamentary election in Kpandai within 30 days.
